End-User License Agreement (EULA)
Article 1: Scope of License
This License Agreement grants you a non-exclusive, non-transferable, and limited license to use this application ("Lowkey") solely on Apple-branded devices that you own or control and only as permitted by the "Usage Rules" set forth in the Apple Media Services Terms and Conditions.
Article 2: Restrictions
You may not, in any way:
Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App (except as expressly permitted by applicable law);
Rent, lease, lend, transfer, resell, sublicense, or distribute the App;
Remove, obscure, or alter any copyright, trademark, or other proprietary notices displayed in or on the App.
Article 3: Termination
This Agreement is effective until you stop using or delete the App, or until the license is terminated by the developer due to your breach of any terms. Upon termination, you must immediately cease all use and delete all copies of the App.
Article 4: Services and Third-Party Content
The App may allow you to access services and content provided by the developer or third parties. Your use of such services or content is subject to the terms and policies of those providers. Apple is not the provider of such services or content and is not responsible for their accuracy or availability.
Article 5: Disclaimer of Warranties
You expressly understand and agree that your use of the App is at your sole risk. Unless otherwise required by law, the developer provides the App "as is" and makes no express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
Article 6: Limitation of Liability
To the maximum extent permitted by applicable law, the developer shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use or inability to use the App, including but not limited to data loss or system failure.
Article 7: Role of Apple
You and the developer acknowledge and agree that:
Apple is not a party to this Agreement;
Apple does not provide any warranty or support for the App;
If the App fails to comply with any warranty, you may notify the developer for repair or refund (if applicable), not Apple;
Apple is not responsible for any claims related to the App, including product liability, legal compliance, or consumer protection claims;
If the App infringes any third-party intellectual property rights, Apple is not responsible for investigating, defending, settling, or discharging such claims.
Article 8: Apple as a Third-Party Beneficiary
You and the developer expressly agree that Apple is a third-party beneficiary of this Agreement and shall have the right (and is deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary.
Article 9: Governing Law
This Agreement shall be governed by the laws of the developer's jurisdiction. Any legal disputes arising in connection with this Agreement shall be subject to the jurisdiction of the courts located in the developer's jurisdiction.
To protect user rights and mitigate potential risks, the Licensor has implemented the following safeguards within the application:
No Collection of Personally Identifiable Information
This app does not require users to provide personally identifiable information such as name, age, phone number, or email address.
All operations are conducted anonymously to avoid risks associated with the collection, storage, or leakage of personal data.
Content Safety Mechanisms
If the app includes features such as commenting, image uploading, or anonymous interaction, mechanisms have been implemented to prevent the circulation of inappropriate content.
Users are strictly prohibited from uploading content that is nude, sexually suggestive, discriminatory, violent, or otherwise offensive to public morals. Such content will be automatically filtered and removed immediately.
Real-Time Reporting and Response Procedures
Users may report inappropriate content using the built-in reporting function. Upon receipt of a report, the Licensor will review and take action within 24 hours.
In the case of severe violations or suspected criminal behavior, such as exploitation of minors, bullying, or sexual violence, the Licensor will retain records and report to or cooperate with the relevant authorities in accordance with the law.
